BJP नेताओं को बचाने के लिए न्याय मंत्रालय ने रातों-रात Justice S Murlidhar का तबादला कर दिया !

            



ऐसा लग रहा है कि देश में न्याय करने वालों को बख्शा नहीं जाएगा।
भाजपा के विषैले और भड़काऊ बयान देने वाले नेताओं के खिलाफ सुनवाई कर रहे दिल्ली हाइकोर्ट के वरिष्ठ जज एस. मुरलीधर का रातों-रात तबादला कर दिया गया। इसे कहते हैं "classical hit&run injustice of BJP govt, ऐसा लग रहा है कि देश में न्याय करने वालों को बख्शा नहीं जाएगा। जब न्यायाधीशों ने भाजपा के केंद्रीय मंत्री, सांसद, विधायक और कपिल मिश्रा के भड़काऊ वीडियो दिखाए तो, केंद्र सरकार के वकील और मोदी जी के चहेते तुषार मेहता जी ने तो ये दलील दे डाली कि, "इस समय नामित अपराधियों के खिलाफ मुकदमे दर्ज करने का उचित समय नहीं है। जस्टिस एस. मुरलीधर की अध्यक्षता वाली उच्च न्यायालय की खंडपीठ ने उक्त वीडियोज के आधार पर 24 घण्टे के भीतर भाजपा नेताओं के खिलाफ IPC के अनुरूप FIR दर्ज करने के आदेश दिए।
परंतु भाजपा नेताओं को बचाने के लिए न्याय मंत्रालय ने रातों-रात जस्टिस एस मुरलीधर का तबादला कर दिया, पूरा देश अचंभित है, लेकिन मोदी शाह सरकार दुर्भावना, कुत्सित सोच व निरंकुशता से ग्रस्त है।

एक मजबूत व स्वतंत्र न्यायपालिका इस देश की रीढ़ है। हमारे देश के इतिहास में न्यायपालिका ने महत्वपूर्ण अवसरों पर इस देश के नागरिकों व इसके संविधान की रक्षा की है, पूरा देश अचंभित है, लेकिन मोदी शाह सरकार दुर्भावना, कुत्सित सोच व निरंकुशता से ग्रस्त है।

एक मजबूत व स्वतंत्र न्यायपालिका इस देश की रीढ़ है। हमारे देश के इतिहास में न्यायपालिका ने महत्वपूर्ण अवसरों पर इस देश के नागरिकों व इसके संविधान की रक्षा की है, यद्यपि ऐसा पहली बार हो रहा है, जब कोई सरकार सत्ता के नशे में इतनी चूर हो कि वह इस देश के संविधान, न्यापालिका एवं देश के नागरिकों के विश्वास को कमजोर करती जा रही है, प्रधानमंत्री एवं श्री अमित शाह को तीन बड़े सवालों के जवाब देने होंगेः
1. क्या आपको यह डर था कि यदि भाजपा नेताओं की स्वतंत्र व निष्पक्ष जाँच की जाएगी, तो दिल्ली की हिंसा, आतंक व अफरा-तफरी में आपकी खुद की मिलीभगत का पर्दाफाश हो जाएगा?
2. निष्पक्ष व प्रभावशाली न्याय सुनिश्चित किए जाने से रोकने के लिए आप कितने जजों का ट्रांसफर करेंगे?
3. क्या आपके पास अपनी ही पार्टी के नेताओं द्वारा दिए गए विषैले बयानों को उचित ठहराने का कोई रास्ता नहीं था, इसलिए आपने उस जज का ही ट्रांसफर कर दिया, जिन्होंने पुलिस को आपकी पार्टी के नेताओं की जाँच करने का आदेश दिया था?
भाजपा द्वारा न्यायपालिका पर दबाव बनाने-बदला लेने का यह पहला मामला नहीं है।
गुजरात दंगों में मोदी-शाह के खिलाफ वकील रहे सुप्रीम कोर्ट के प्रसिद्ध वकील श्री गोपाल सुब्रमण्यम की नियुक्ति को मोदी सरकार ने जबरन रोक दिया व सुप्रीम कोर्ट कॉलिजियम के आदेशों की परवाह नहीं की
इसी प्रकार से उत्तराखंड में कांग्रेस की सरकार को नाजायज तौर पर बर्खास्त कर राष्ट्रपति शासन लगाने के निर्णय को सिरे से खारिज करने वाले न्यायाधीश केएम जोसेफ की नियुक्ति को मोदी सरकार द्वारा महीनों तक रोक कर रखा गया
मोदी सरकार ने न्यायाधीश अकील कुरैशी की नियुक्ति को भी रोककर रखा, जिन्होंने श्री अमित शाह को 2010 में जेल भेजा था। यह इसके बावज़ूद हुआ कि सुप्रीम कोर्ट के कॉलिजियम ने यह रिकमेंडेशन सरकार को भेजी थी,  शैल कंपनियों के बारे सरकार के खिलाफ असहज निर्णय देने वाली जस्टिस गीता मित्तल का भी इसी प्रकार से तबादला कर दिया गया। बात साफ है कि अगर न्यायाधीश सरकार की नीतियों पर संविधान के अनुरूप अंकुश लगाते हैं, तो मोदी सरकार बदले की भावना से काम करेगी, भाजपा सरकार एवं इसके नेता 2019 में अपनी चुनावी जीत के नशे में चूर हैं।

उन्हें यह याद रखना चाहिए कि देश के नागरिकों ने उन्हें देश की सेवा करने व शासन चलाने के लिए चुना है, न कि डराने, धमकाने व लोगों को गुलाम बनाने के लिए, भाजपा के नेता यह भूल जाते हैं कि न्यायपालिका केवल एक सिद्धांत का पालन करती है और वह सिद्धांत है - ‘‘सत्यमेव जयते’’। अंत में सदैव सत्य की विजह होती है
प्रधानमंत्री, गृहमंत्री एवं उनकी सरपरस्ती में काम करने वाले लोगों से हमारा वादा है: चाहे कितना भी झूठ फैला लो, चाहे कितने भी झूठे खंडन कर दे, सत्य सामने आकर रहेगा, हमें इस बात में कोई संदेह नहीं कि जो माननीय जज आज 2 बजे इस मामले की सुनवाई करेंगे, वो उसी साहस, प्रतिबद्धता व स्वतंत्रता के साथ न्याय प्रक्रिया को आगे बढ़ाएंगे, जिसके साथ जस्टिस मुरलीधर ने इस अहंकारी, प्रतिशोधपूर्ण व अकुशल भाजपा सरकार को कटघरे में खड़ा किया, भय और नफरत का माहौल पैदा करने वाले किसी भी व्यक्ति को छोड़ा नहीं जाना चाहिए। चाहे वो किसी भी राजनैतिक दल से हो,



It seems that those who do justice in the country will not be spared. Senior Delhi High Court Judge- S.R.Muralidhar, who was hearing the case involving BJP leaders that gave hate speech was transferred overnight. It is called classic hit & run injustice of BJP govt. BJP's pressure against judiciary & politics of revenge stand exposed. Yesterday, judges S Muralidhar & Talwant Singh of Delhi HC bench, took note of BJP leaders role in riots, filed an FIR against them and ordered Delhi Police to act in accordance with Constitution.When the judges showed provocative videos of BJP's Union Minister, MP, MLA and Kapil Mishra, Tushar Mehta ji, a lawyer of the Central Government and a favourite of Modi ji, argued that, "it is not the right time to file cases against the named offenders, Justice S. Muralidhar of High Court bench ordered registration of FIR against the BJP leaders as per IPC within 24 hours on the basis of the said videos. But in order to save the BJP leaders, the Ministry of Law & Justice transferred Justice S. Muralidhar overnight, Entire country is astonished, but Modi-Shah govt is plagued with malice & autocracy. A strong & independent judiciary is the backbone of this country. Judiciary has protected Indian citizens and its constitution on important occasions in the history of our country, This is happening for the first time, when a government is so high on power that it is weakening the constitution, the legislature and the trust of the citizens of this country.
The Prime Minister and Mr. Amit Shah need to answer three big questions:
1. Were you afraid that if the BJP leaders were investigated independently and impartially, your own collusion would be exposed in the violence, terror and chaos in Delhi?
2. How many judges will you transfer to prevent fair and effective justice?
3. Did you have no way to justify the toxic statements made by the leaders of your own party, so you transferred the judge who ordered the police to investigate the leaders of your party?
It's not the first case of BJP pressurising judiciary or being vengeful. Appointment of Mr. Gopal Subramaniam, famous lawyer of Supreme Court who was a lawyer against Modi-Shah in Gujarat riots, was forcibly stopped and orders of the Supreme Court Collegium ignored
Justice Geeta Mittal, who gave an uneasy judgment against govt about shell companies, was also transferred in a similar manner. It's clear that if judges curb government's policies as per the constitution, then the Modi government will work with a sense of revenge
The BJP government and its leaders are drunk on their electoral victory of 2019. They should remember that the citizens of the country have chosen them to serve the country and run the government, not to intimidate, threaten and enslave the people.
BJP leaders forget that the judiciary follows only one principle and that principle is 'Satyamev Jayate'. In the end there is always the victory of truth.Our promise to the Prime Minister, the Home Minister and the people working under their patronage- no matter how many lies you spread or deny, the truth will come to the fore.
